TERMS AND CONDITIONS OF SALE

1.     DEFINITIONS AND INTERPRETATIONS

1.1    In these terms and conditions:

 Reference to “we” and “us” is a reference to Fetes Cadeaux.
 
 Reference to “you” is a reference to the purchaser of the Goods from us.

“Contract”     means the contract between us for the sale and purchase of the Goods which incorporates these Terms & Conditions.

“Goods”     means the Party Articles, Costumes, Accessories, Jewellery, Gifts and other items purchased by you from us.

    “Terms”     means these terms and conditions.

1.2    These Terms are the only terms and conditions on which we contract for the sale of Goods and they form an integral part of the Contract between us. If we agree to vary any of the terms, the variation must be in writing confirmed by our duly authorised representative and by you.

1.3    We reserve the right to amend these Terms and Conditions at any time without prior warning.

PRICE

2.1    The price of Goods quoted on our website includes VAT (Value Added Tax).

2.2    All prices are quoted and payable in Euros. All item prices are excluding post and packing costs. The prices shown on your invoice is quoted in Euros. All orders must be paid for in one single payment at the time of placing the order.
 
2.3    The cost of packaging and postage/carriage is shown separately. In the case of special or overseas orders, the cost of post and packaging will/can be quoted by us on request. TVA is also included in the price of post and packing.

2.4    All published prices are subject to change at any time without notice. The price quoted at the time of confirmation of the order is the price applied to your order.

3.    ORDERING GOODS ONLINE

3.1    You warrant to us that all information which you are required to provide when ordering Goods online is accurate and complete in all respects at the time of the order and that this information relates to you/the person placing the order and not to any third party.

3.2    When an order is made online, the order confirmation issued by the company clearing the credit/debit card payment does not constitute acceptance of your order by us. We reserve the right to check any discrepancies and an order will only be confirmed when it is verified by us.
 
3.3    Any errors in any ordering process due to technical or other reasons beyond our control entitles us not to treat the order as being binding on us.

4.    PRIVACY

    If you place an order, you will have to provide personal information to us. We do not disclose clients information to any third party, except for the purpose of processing the order and arranging delivery. Fetes Cadeaux is concerned about protecting your privacy and therefore treats all information concerning you as strictly confidential. When you make a purchase, we only ask you for information (surname, firstname, address, email address) which we must have if we are to provide a high standard of order processing and monitoring.

5.    PAYMENT

5.1    All payment for Goods and for the cost of packaging and delivery must be made before the Goods are delivered.

5.2    Payment online can be made by bank, credit or debit card, or Paypay. Your card will be debited when we send your order.
    We accept payment by cheque (via a French bank only) but the order will not be posted until the cheque has been received and banked by us. Payment by cheque should be sent as follows:

    In all cases, delivery will not occur until we are satisfied that the payment has been made. In the case of a payment by cheque, this will be after the cheque has been cleared.


6.    DELIVERY

6.1    Goods in stock are normally delivered 24 / 48h after receipt of your payment.
    The delivery time comprises the time needed to prepare the package plus the time to deliver it.
    The average delivery time is 8 days for France but this does not represent an absolute deadline and Fetes Cadeaux shall no be held liable in the event of late delivery or stock shortage at the publisher or supplier.
    You will be given an estimated delivery date for the Goods but no times or dates provided by us are guaranteed as we cannot guarantee that the chosen Postal Service and methods will be delivered as stated in their terms.

6.2    We will arrange for packing but you have the option decide on the method of delivery - however; absolutely no responsibility whatsover is taken by us when you choose to have your goods delivered by normal letter post. (This option is available for French and UK residents only). Our preferred method of delivery is by courrier; ie Lettre Max, Lettre Suivie or Colissimo where you will be required to sign for or collect your parcel and your parcel can be tracked.

6.3    You must notify us promptly and in any event within 48 hours of receipt of any Goods if they appear to be damaged in transit.  In those circumstances, you must keep your invoice and all item packaging must be intact and unopened when making a claim.

6.4    If you have ordered a few items but some of the items are not in stock, the goods will be sent to you as and when all the items have been received. If you would like to receive the goods as they are in stock, or as they arrive, you need to send an email to This e-mail address is being protected from spambots. 6.5    All goods are delivered to the address supplied by you when you make the order.

7.    CANCELLATION

7.1    In accordance with article L.121-16 and following the Code (Code de la Consommation) you have a right to cancel an order within 7 working days from the date that you receive the Goods. Cancellation must be confirmed to us in writing. You then have 15 working days to return the goods to us. Failure to report the cancellation in writing, or to return the goods within the time stated will result in the loss of your rights.

7.2    You must take reasonable care of all Goods in your possession and return them to us, appropriately packaged to avoid damage, within 7 days from the cancellation date. We reserve the right to arrange collection, in which case you will be responsible for collection charges. All charges in connection with returned goods are your responsibility and not a charge of this company.

7.3    We will refund the purchase price to you within 30 days of the cancellation notice. The return of the goods to us is your responsibility and charge. We do not pay for goods to be returned to us - unless - they are faulty or damaged. Goods must be returned unused and unopened. We will refund you the cost of the returned items only; not the original postage and package costs or the costs to return the items to us - unless the items are damaged or faulty. Items returned but not in their original packaging will not be re-imbursed. Re-imbursements are paid by cheque and addressed to the client as per the information given to us on the order form.

7.4    In the case of Goods which are made and supplied to your specification or which have been personalised for you, you will not have the right to cancel the Contract.

8.    RISK AND OWNERSHIP

8.1    The risk of loss or damage to Goods passes to you upon (our confirmation of) delivery. If you have agreed to collect the Goods from us, the risk in those Goods passes to you on collection (or 7 days after the date of the collection agreed between us if you have not collected the Goods by then).

8.2    Ownership in all Goods remains with us until full payment of all amounts due to us have been received from you.

8.3    You will be responsible for the safe custody and insurance of all Goods in your possession.

8.4    You have no right to re-sell any Goods until payment has been received in full by us.

9.    WARRANTIES AND LIABILITY

9.1    We warrant to you that the Goods ordered by you will meet the description as shown on our website (or any other description given to you in writing).

9.2    We will not have any responsibility for any damage which occurs to the Goods after delivery.

9.3    We do not accept any responsibility for any wear and tear, accidental damage or failure by you or by any third party to adhere to any written recommendation provided in relation to the Goods.

9.4    Liability to you for loss or damage under no circumstances must exceed the total amount you have paid us for those Goods.

10.    NOTICES

10.1    If you wish to give us any notice relating to a matter covered by these Terms, whether you telephone us or not, you must confirm that notice in writing. 11.    FORCE MAJEURE

    We will not have any liability to you if we are prevented from performing any of our obligations on account of any circumstances beyond our reasonable control  which includes, but is not limited to, extreme weather conditions, act of God, terrorism, war, strike or difficulty in obtaining materials and/or labour. In any of these circumstances we reserve the right to terminate the Contract. 

12.    GENERAL

12.1    Severance: If any provision in these Terms is held by a court to be unenforceable, that will not affect the remaining provisions of the Terms.

12.2    Entire Agreement: These Terms govern our relationship with you and in accepting them, you confirm that no other arrangement, agreement or representation applies. By agreeing to these Terms and Conditions you are acknowledging that you have complete understanding of them and that you thereby waive the right to take advantage of any conflicting document and, in particular, you own general terms and conditions of purchase. The act of making your order/purchase means your acceptance of these general terms and conditions of sale.

12.3    Assignment: We reserve the right to assign any of our rights or obligations under the Contract with you to a third party on the basis that the existing contractual terms will become the responsibility of that third party. You will not assign your rights without first getting our written consent.

13.    INTELLECTUAL PROPERTY

    Where the Goods include designs or works of art, these are prepared by a designer or artist who owns the copyright in those works. You have no right to make any copies or adaptations of any such Goods.
